Governor of Bagmati Province

The governor of Bagmati is the Constitution head of province executive of Bagmati Province. The governor is appointed by the President of Nepal on recommended by federal cabinet for a tern of five years, and office at the President's pleasure. The role was first created in 2018.

The current governor is Yadav Chandra Sharma who was appointed and took office on 20 August 2021. The position has been held by three people in a permanent capacity since its creation.

The governor is de jure head of the provincial government; all its executive actions are taken in the governor's name. However, the governor must act on the advice of the popularly elected council of ministers, headed by the chief minister, which thus holds de facto executive authority at the province-level. The Constitution of Nepal also empowers the governor to act upon his or her own discretion, such as the ability to appoint or dismiss a ministry, recommend president's rule for the president's assent.[1]

Power and functions

  • The Chief of State shall exercise such powers and perform such duties as conferred to him or her pursuant to this Constitution or law.[2][3]
  • In exercising the powers or duties under clause (1), the Chief of State shall perform all other functions to be performed by him or her on recommendation and with the consent of the State Council of Ministers than those functions specifically provided to be performed on recommendation ofany body or official pursuant to this Constitution or law. Such recommendation and consent shall be submitted through the Chief Minister.
  • Any decision or order to be issued in the name of the Chief of State under clause (2) and other instrument of authorization pertaining thereto shall be authenticated as provided for in the State law.
  • The Chief of State shall, prior to assuming office, take an oath of office and secrecy before the President, as provided for in the Federal law.
  • Constitution of State Council of Ministers: (1) The Chief of State shall appoint the leader of the parliamentary party commanding a majority in the State Assembly as the Chief Minister, and the State Council of Ministers shall be constituted under his or her chairpersonship.
  • In cases where no party has a clear majority in the State Assembly under clause (1), the Chief of State shall appoint as the Chief Minister a member of the State Assembly who can command majority with the support of two or more parties representing to the State Assembly.

Qualified of Governors

Article 164 of the Constitution of Nepal states that:

1. being qualified for being a 2. member of the Federal Parliament, 3. having completed the age of thirty five years, and not being disqualified by any law.
